Kurt Larkin Media Coverage on UPS Freight v. NRLB
Kurt Larkin’s remarks from the DC Circuit arguments in UPS Freight v. NRLB were featured in multiple news outlets. Kurt told the court that a speedy union election ordered by a regional director of the National Labor Relations Board was unfair. The NLRB director ordered a “quickie” election by UPS Freight employees to decide whether to unionize. The rule allowing such elections “values speed at all costs,” Kurt said. “The only goal is to get the election done as quickly as possible—rushing through the process and denying the employer a fair shake.” He also said that the regional director’s decision to order a mail ballot meant that the company had to cut off its arguments to employees prematurely. “I subscribe to the notion that there’s nothing like a good, old-fashioned, face-to-face conversation,” he argued.
