A recent US Supreme Court ruling undermines a West Virginia trial judge’s decision that limits the state’s right-to-work law, Elbert Lin told Talkline Radio. Elbert, the former solicitor general of West Virginia, led a previous effort overturning an earlier injunction issued by the same trial judge against the law, which unions oppose. Since that previous litigation, the US Supreme Court has issued Janus v. AFSCME, which “suggests that the Supreme Court believes the free speech and association rights of the nonmember employees is what’s important, not the purported associational rights of the union itself,” he said.
