Overview

Michael represents corporate clients in all manner of labor and employment matters, including non-compete and trade secret litigation, wrongful termination, wage and hour disputes, and union organizing.  Michael also advises organizations and their management teams on labor and employment and employee benefit matters in formation, mergers and acquisitions, and restructurings.  He has litigated labor and employment cases in federal and state trial and appellate courts around the country and before the NLRB and EEOC and has represented clients in all aspects of labor-management relations, including representation elections, and has helped clients develop campaign management strategies and litigation responses to corporate campaign activities.  Michael received his undergraduate degree from the University of Texas and his masters and law degrees from Texas Tech University.

Experience

  • Represents corporate and management team clients in disputes and negotiations regarding executive employment agreements, restrictive covenants, and other employment-related agreements.
  • Advises corporate clients and management teams in corporate formation, mergers and acquisitions, and restructuring, including disputes and negotiations related to partnership agreements, executive employment agreements, and other employment-adjacent agreements.
  • Represents employers across the country before federal and state agencies, such as the Equal Employment Opportunity Commission, Department of Labor, Texas Workforce Commission, and other state enforcement agencies.
  • Represents clients before the National Labor Relations Board, including prosecution and defense of unfair labor practice charges.
  • Advises clients regarding union organizing campaigns.
  • Counsels clients regarding wage and hour and misclassification issues.
  • Provides in-person training to clients on labor and employment issues.
  • Represents employers in federal and state court lawsuits involving claims for sexual harassment, discrimination and retaliation.
  • Counseled management team of private equity backed E&P company in renegotiating management services agreement and entering new joint development agreements.
  • Advised hydroelectric company on employment matters related to executive hiring, retention, and incentive compensation in corporate restructuring.
  • Prosecuted trade secrets and unfair competition claims for national technology consulting corporation serving Fortune 100.
  • Assisted energy company with National Labor Relations Board RC Petition regarding union representation of multiple distribution and operation centers.
  • Defended national retailer regarding National Labor Relations Board allegations of concerted activity protected under the NLRA.
  • Advised and represented national retailer regarding election campaign petition in New York.
  • Represented health care industry company in allegation of wrongful termination charges filed before the National Labor Relations Board.
