On September 18, 2019, the Presidency of the European Council published its proposed amendments to the Proposal for a Regulation Concerning the Respect for Private Life and the Protection of Personal Data in Electronic Communications (the “Draft ePrivacy Regulation”). The Draft ePrivacy Regulation will replace the ePrivacy Directive and will complete the EU’s framework for data protection and confidentiality of electronic communications.
The Presidency proposed numerous amendments to the draft text, including amendments to the provisions on the processing of electronic communications metadata. However, the proposed amendments to the provisions on direct marketing and cookies are not substantial compared to the previous drafts of the text.
On September 24, 2019, the revised text will be further discussed during a meeting of the Council’s Working Party on Telecommunications and Information Society.

On December 31, 2021, the French Data Protection Authority (the “CNIL”) imposed a €150,000,000 fine on Google and a €60,000,000 fine on Facebook (now Meta) for violations of French rules on the use of cookies.
