On January 25, 2019, the Centre for Information Policy Leadership (“CIPL”) at Hunton Andrews Kurth submitted formal comments to the International Conference of Data Protection and Privacy Commissioners (the “International Conference”) on its Declaration on Ethics and Data Protection in Artificial Intelligence (the “Declaration”). The Declaration was adopted by the International Conference on October 23, 2018, for public consultation.

As we previously reported, the Declaration endorses several guiding principles as core values to preserve human rights as artificial intelligence technology develops. CIPL welcomes and shares many of the views expressed by the International Conference with respect to these six guiding principles.

In its comments on the Declaration, CIPL recommends several specific modifications and clarifications to the guiding principles of fairness, continued attention and vigilance and accountability, transparency and intelligibility, responsible design and development, individual empowerment and reducing or mitigating unlawful biases and discriminations.

These comments are intended to assist the newly set up International Conference permanent working group on Ethics and Data Protection in AI as it seeks to establish common governance principles on artificial intelligence at an international level.
