On August 28, 2024, the Federal Communications Commission announced that it signed a Memorandum of Understanding on Cooperation in the Enforcement of Laws Protecting Personal Information in the Private Sector (the “MOU”) with the Office of the Privacy Commissioner of Canada.

The MOU establishes a commitment for the agencies to share information to enforce compliance with privacy requirements in both countries. The MOU is also designed to enable the exchange of expertise on regulatory policies and technical efforts related to applicable laws.

This MOU does not mark the first time the U.S. and Canada have entered into an MOU to collaborate on privacy issues. In 2022, for example, the FCC entered into a Memorandum of Understanding with the Canadian Radio-television and Telecommunications Commission to bolster enforcement cooperation and collaboration against illegal robocalls.
