New Annual Asylum Fee Requirement Effective in May

A US Citizenship and Immigration Services (USCIS) interim final rule implementing a new Annual Asylum Fee goes into effect on May 29, 2026, and carries serious consequences if the fee is not paid within 30 days of notification.  The Administration’s Big Beautiful Bill included a new filing fee for asylum applications, as well as a new annual fee for pending asylum applications.  Failure to pay the annual fee within 30 days of notification can lead to a rejection of the pending asylum application, and for applicants without underlying legal statuses, removal from the United States.  While all non-US citizens of the United States (including green card holders and other non-immigrant visa holders) are required to update USCIS of their US address changes within 10 days of the change, it is vitally important for asylum applicants to do so to ensure that they receive the annual asylum fee notices so that they can pay timely without jeopardizing their applications.  The online AR-11 address change form can be found here.  While updating their addresses, asylum applicants must indicate that they have pending applications and include the receipt numbers for each application to ensure that notices are sent to the proper locations.
