Federal agency compliance with the requirements of the National Environmental Policy Act (NEPA) can be a major driver of federal permitting for critical infrastructure. During this program, the panel will provide an overview of NEPA requirements and best practices. We will address key issues, such as the appropriate level of NEPA review, the critical elements of a NEPA analysis, and litigating NEPA claims. We will also discuss recent developments, including recent examples and Council for Environmental Quality regulations and policy documents.
