AmLaw Names Michael Mueller ‘Litigator of the Week’ for Back-to-Back Appellate Wins

In recognition of two appellate victories for a firm client in separate wage and hour class actions, American Lawyer named Michael Mueller its “Litigator of the Week” (Litigation Daily, August 27). The cases involved individual claims brought under the Fair Labor Standards Act and Rule 23 class claims under the Nebraska Wage Payment Collection Act challenging the company’s pay practices at two of its Nebraska meat-processing facilities. After a bench trial in the first case, the district court entered judgment against the company of nearly $19 million. In the second case, a jury awarded plaintiffs a small fraction of the amount of time they had sought, and the district court entered judgment of nearly $5 million.

Mike Mueller, Washington, argued the cases back-to-back before the US Court of Appeals for the Eighth Circuit, which, on August 26, issued both rulings rejecting the claims by the two separate groups of plaintiffs.
