Shelving outfit prevails in patent dispute in state court
Virginia Lawyers Weekly
Design Assistance Construction Systems, Inc. sued former Director David Cross; his son, Jordan Cross; and Sierra Shelving, Inc., regarding various breaches and torts related to David Cross accepting an approximate $2 million buyout at DACS and then joining with his son to compete against DACS in the highly specialized archival storage industry. Bob Tata, partner with the firm's Norfolk office who won the case for DACS, was gratified by the judge's decision to award DACS its principal competitor's entire patent portfolio, the infringing product, and a fee award included in the equitable relief.
Tata's practice includes complex commercial litigation, intellectual property (copyright, trademarks, trade dress, trade secrets and patent) litigation, admiralty and maritime law, mass tort and products liability defense, government contracts, employment law, and personal injury and wrongful death defense in federal and state courts.
