Court of Appeals for the Federal Circuit Affirms Summary Judgment for Sony in Patent Suit Against Trans Video

New York, New York, August 13, 2012 -- The Court of Appeals for the Federal Circuit affirmed a grant of summary judgment to Kenyon client Sony, invalidating the asserted claim of the patent in suit for lack of written description, and affirmed the district court's denial of plaintiff Trans Video's motion to amend its infringement contentions to assert another claim. The judgment was affirmed per curiam under Federal Circuit Rule 36. The district court case, captioned Trans Video Electronics, Ltd. v. Sony Electronics Inc., et al., CV-09-03304-EMC (USDC, N.D. Cal.) was filed on July 20, 2009. The patent in suit, U.S. Patent No. 5,991,801, concerns a global digital video news distribution system. Trans Video contended that Sony infringed by distributing video content, including movies and games, through Sony's PlayStation Network to users of the PlayStation 3 and PlayStation Portable products, as well as other devices that connect to the Internet.
