Kenyon Successfully Represents Toyota in IPR

November 13, 2014 – Kenyon & Kenyon LLP successfully represented client Toyota in the first of several inter partes review (IPR) proceedings initiated by Toyota against Acacia subsidiary American Vehicular Sciences (AVS). The Patent Trial and Appeal Board (PTAB) invalidated all of the asserted claims of USP 7,650,210 relating to systems that transmit diagnostic information from automobiles to remote locations. The ‘210 patent is one of 24 patents originally asserted by AVS against Toyota, and later against other automobile companies, in a series of litigations which began in the Eastern District of Texas in 2012 and have since been transferred to the Eastern District of Michigan. The litigations are currently stayed pending the outcome of several IPR proceedings instituted on petitions filed by Toyota. The ruling in Toyota’s favor found all of the asserted claims invalid on multiple grounds including anticipation over two different references and obviousness over one of the references in combination with others.
