In February 2009, the Department of Justice’s decade-long waffling over its policy on the waiver of attorney-client privilege in corporate investigations was moved back to Congress by Sen. Arlen Specter, the senior minority member of the Senate Judiciary Committee. Sam Danon, a litigation partner in the firm’s Miami office, pointed out that the Specter bill will cover everyone while DOJ policy doesn’t reach other federal agencies that have similar policies.
