Quoted, US court says insurer has no duty to defend cyber attack negligence lawsuit, Global Data Review
Walter Andrews tells Global Data Review that the Florida Court should not have relied on incorrect precedent in a case involving insurance for damage caused by a third-party computer hack. The federal court in Orlando ruled that third-party hacks are not necessarily covered by property insurance, but Walter commented that there should have been coverage in this instance. In addition, Walter explains that there are lessons to be learned from the decision: “Given how strenuously the insurers are fighting to deny coverage for data breach claims, a readable takeaway is that policyholders should consider getting very specific cyber coverage.”
