Holly E. Cerasano

Holly represents health system, hospital, health care provider, and other health care company clients in regulatory compliance and transactional matters. She advises on issues arising from ongoing operations, including health privacy and security obligations, Stark and Anti-Kickback compliance, medication prescribing and dispensing requirements, and Virginia health care provider scope of practice matters. Holly also counsels clients on acquisition, disposition, and joint venture transactions and assists with certificate of public need matters.

Holly provides pro bono services as a member of the Mid-Atlantic Innocence Project Case Screening Committee and participates in community service events for FeedMore and the Cystic Fibrosis Foundation.

• Advises health system, hospital, health care provider, and other health care company clients on:
  • health privacy and security matters, including compliance with the HIPAA Privacy and Security Rules, HITECH Act breach notification obligations, and 42 C.F.R. Part 2 confidentiality requirements;
  • certificate of public need matters, including the establishment of new hospitals and ambulatory surgery centers, hospital bed and operating room expansions, and hospital and health care facility service line initiations and expansions, as well as equipment acquisition and expansion;
  • fraud and abuse compliance related matters, including Stark and Anti-Kickback matters; and
  • a variety of contractual matters, including professional services, co-management, and other services arrangements.
• Advises health system clients on acquisition, disposition, and joint venture transactions.
• Advises retail pharmacy chains on statutory and regulatory compliance matters related to the prescribing and dispensing of contraceptives and gender-affirming medications.
• Advises health system and hospital clients on Virginia health care provider scope of practice matters.
• Provides health care regulatory support to the firm’s corporate practice on transactions involving health care companies.
