Overview

David represents clients in high-stakes appeals, particularly in the Fourth Circuit. He has drafted multiple cert-stage and merits briefs in the United States Supreme Court, and also briefed appeals in the First, Second, Third, Fourth, Ninth, Eleventh, Federal, and DC Circuits, along with state appellate courts. He has also argued appeals in the Second, Fourth, and Ninth Circuits, and state appellate courts. David’s appeals cover a broad range of subjects, with a particular focus on First Amendment and insurance litigation. 

David’s appellate experience dates back to law school, where he excelled in the University of Virginia’s Supreme Court Litigation Clinic, leading to a clerkship for former Chief Judge D. Brooks Smith on the Third Circuit. He then practiced at an international law firm in Washington, DC, before joining Hunton’s issues and appeals team.

David is also an accomplished trial litigator, with an emphasis on dispositive motions.

Experience

Since joining Hunton, David has represented Fortune 500 companies and other important clients in a variety of civil matters, including:

  • Defending a $43 million trademark infringement award in the Fourth Circuit and United States Supreme Court.
  • Assisting the Commonwealth of Virginia in petitioning the United States Supreme Court, and successfully overturning unanimous circuit precedent, in a case concerning eligibility for attorney’s fees under Section 1988.
  • Petitioning the United States Supreme Court to overturn its prior precedent and vacate a $22 million damages award in a wage dispute under the Fair Labor Standards Act.
  • Petitioning the DC Circuit on behalf of prominent industry groups, seeking vacatur of a first-of-its-kind EPA rule designating new substances under the Comprehensive Environmental Response, Compensation, and Liability Act.
  • Briefing and arguing a federal-preemption appeal in the Ninth Circuit on behalf of a nationally renowned federal credit union.
  • Briefing and arguing a defamation appeal in the DC Circuit on behalf of a satellite company.
  • Successfully petitioning the Alabama Supreme Court for a writ of mandamus, resulting in the dismissal of claims against a chemical manufacturer for lack of personal jurisdiction.
  • Defending major media outlets against defamation claims in state and federal appellate courts, including arguing a successful appeal in the Second Circuit.
  • Defending a major media outlet against tort claims in the Third Circuit.
  • Briefing insurance appeals in the First, Third, Fourth, Ninth, and Eleventh Circuits, and state appellate courts.
  • Representing an energy company in the Fourth Circuit, resulting in reinstatement of a $7.6 million verdict and a remand for additional damages.
  • Defending a major energy company against class-action employment discrimination claims in the Fourth Circuit.
  • Defending a meat producer against agricultural nuisance claims in the Fourth Circuit.
  • Defending a pharmaceutical company against employment discrimination claims in the Ninth Circuit.
  • Pursuing patent infringement claims for a software company in the Federal Circuit.
  • Pursuing fraud and breach-of-contract claims for a meat producer in the Virginia Supreme Court.
  • Filing an amicus brief concerning the constitutional limits of personal jurisdiction in the United States Supreme Court.
  • Providing ongoing advice to Ginnie Mae regarding its government guaranteed multiclass securities program.
