California Attorney General Issues Proposed Regulations for CCPA

On October 10, 2019, the California Attorney General (“AG”) announced Proposed Regulations implementing the California Consumer Privacy Act of 2018 (“CCPA”). Along with a Notice of Proposed Rulemaking Action and the Text of Proposed Regulations, the AG issued an Initial Statement of Reasons elaborating on the purposes of the proposed regulations.

According to the AG, “The proposed regulations would establish procedures to facilitate consumers’ new rights under the CCPA and provide guidance to businesses for how to comply.”

In a press conference discussing the regulations, the AG’s Office stressed that the draft of the proposed regulations and Initial Statement of Reasons are among the best resources explaining the CCPA’s expected implementation. The AG also stated that July 1, 2020, is the expected date of final regulations and enforcement. January 1, 2020, is the CCPA’s compliance date.

Before final regulations are issued, interested parties may submit written comments regarding the proposed CCPA regulations by mail or email, or at four scheduled public hearings throughout California. The deadline to submit written comments is December 6, 2019 at 5:00 p.m. (PST).
