The Centre for Information Policy Leadership at Hunton recently filed responses to consultations from Colorado, Canada, and Australia, each of which addressed issues of children’s privacy and safety.

The Colorado Department of Law sought informal input on the Department’s upcoming rulemaking implementing the Children’s Privacy Amendment to the Colorado Privacy Act. On July 11, 2025, CIPL filed a response urging the Department to consider a nuanced approach to its assessment of system design features potentially covered by the rule.

On July 31, 2025, CIPL filed a response to a consultation by the Office of the Australian Information Commissioner (“OAIC”) addressing the development of the Children’s Online Privacy Code. CIPL commended the OAIC for its effort to provide clarity on these issues, stressing the importance of embedding a risk-based approach in the Code to ensure an effective and proportionate approach to children’s privacy and safety online.

On August 1, 2025, CIPL filed a response to an exploratory consultation by the Office of the Privacy Commissioner of Canada (“OPC”) on the development of a Children’s Privacy Code. CIPL encouraged the OPC to develop a Code that embraces a flexible, outcome-driven, and risk-based approach.
